The following General Terms and Conditions of Sale govern the offer and sale of products on our website www.capslov.com.

 

The products purchased on www.capslov.com are sold directly by HILARIS S.r.l.  (hereinafter referred to as "we" or "the Seller"), with registered office in Italy at Via Santo Domingo 3, 00071 Pomezia (Rome), tax code and registration with the Companies Register number 17860481005 , VAT number IT17860481005, R.E.A. number RM 1747065, share capital of €10,000.00, paid up to  €2,500.00.

You can request any information through our Customer Service. 1. Our Business Policy

The Vendor offers products for sale on www.capslov.com and conducts its e-commerce business exclusively with its end users who are "consumers".

"Consumer" means any natural person who acts on www.capslov.com for purposes unrelated to their trade, business, or professional activity, if any. If you are not a "consumer", please refrain from entering into business transactions on www.capslov.com.

In consideration of its business policy, the Vendor reserves the right not to process orders from persons other than the "consumer" or orders that do not comply with its business policy.

These General Conditions of Sale exclusively regulate the offer and sale of products on www.capslov.com between consumers and the Vendor.

The General Conditions of Sale do not, however, regulate the provision of services or the sale of products by parties other than the Vendor that are present on www.capslov.com through links, banners, or other hypertext links. We advise you, before placing orders and purchasing products and services from parties other than the Vendor, to verify the applicable conditions of sale, as we will not be responsible for the provision of services by third parties other than the Vendor or the conclusion of transactions between users of www.capslov.com and third parties.

2 . How to Conclude the Contract with the Seller

The presentation of products on www.capslov.com, together with their relative prices, does not constitute a proposal, but rather an invitation to offer. If you wish to purchase one or more products on www.capslov.com, you must submit an order, following the online purchase process, which means you must:

 

(i) add the products to the shopping bag,

(ii) click on the "Proceed to checkout" button,

(iii) enter your e-mail address

(iv) choose whether to proceed with or without registration (as a guest) to the website,

(v) fill in the order form with your personal data (name, surname, address, e-mail, telephone, shipping/billing address),

(vi) select the shipping and payment methods,

(v) accept these terms and conditions of sale and

(vi) send the order form through the site.

Before sending the order form, you will be given the opportunity to verify and possibly correct any errors and you will also be asked to carefully read these General Conditions of Sale and the Return Policy and, if you wish, you can print a copy using the print option and keep it for personal use.

By transmitting the order form to the Seller and concluding the contract, you unconditionally accept and undertake to observe the provisions contained in these General Conditions of Sale and in the General Conditions of Use as well as in the Return Policy. If you do not agree with some provisions of these General Conditions of Sale or with other provisions that govern the relationship with the Seller contained in the General Conditions of Use and in the Privacy Policy, we invite you not to submit the order for the purchase of products on www.capslov.com.

The order form will be stored in our database for the time necessary to process the order and in accordance with the terms of the law. You can access the order by clicking on the "Track your order" section in the footer of the site.

Upon transmission of the order form, you will receive an automatic email confirming the receipt of the purchase order ("Confirmation of receipt of the purchase order"), containing a summary of the information relating to the order (i.e., link to the General Conditions of Sale, brief summary of the main characteristics of the products, including information relating to the price, payment methods and shipping costs).

 

Confirmation of receipt of the order form does not however mean that the order has been accepted. All orders sent are in fact subject to the express acceptance by the Seller.

The Seller reserves the right not to process purchase proposals, for legitimate reasons, when - for example1 - there are insufficient guarantees of solvency, when the orders are incomplete or incorrect, or the products are no longer available. In such cases, we will notify you by e-mail (to the address indicated in the order) that your purchase proposal cannot be processed, also specifying the reasons. In the event that one of the aforementioned events occurs, where necessary, we will unblock any pre-authorized amounts without delay.

The contract will be considered concluded only if and when you receive a communication via e-mail confirming the shipment of the products ("Acceptance of the order and confirmation of shipment").

We will provide you with a summary of the applicable conditions, including a link that will refer to the full text of these General Conditions of Sale and the Return Policy, as well as a summary of the main characteristics of each product ordered and its price (including all applicable taxes and duties), the type of payment you used to purchase each product, the delivery methods of the purchased products, the shipping costs, as well as the Seller's data and our contacts (including geographical address and email address) as well as an indication of the estimated date by which the Seller will be able to deliver the products to you.

The Seller will also provide you with a summary of these General Conditions of Sale, which govern your purchases, including a reference to your right of withdrawal, to any costs for returning the products (where applicable) and to the legal guarantee of conformity of the products.

You agree to receive the purchase receipt in electronic format. If you have completed your order as a registered customer, you can find the receipt together with all the order details and the updated shipping information on the Order Detail page. If you have purchased as an unregistered customer you can find and download the receipt of your order at any time from the Track your order page where you can also view the updated shipping information. If you have chosen the option to also receive the invoice, you will always find it on these pages together with the receipt.

The official language used for the conclusion of contracts is english while we are available to use the language of the country from which the purchase is made when inquiries might arise.

3. Warranties, Indication of Product Prices, and Legal Guarantee

On www.capslov.com, we exclusively offer for sale products bearing trademarks owned by CAPSLOV for HILARIS S.r.l. 

The Seller does not sell second-hand or defective products on www.capslov.com.

The essential characteristics of the products are shown on www.capslov.com within each product sheet. Despite our commitment to ensuring that you can view images that correctly and accurately reflect the products offered for sale on www.capslov.com, such images and colors may not correspond to the real ones due to the Internet browser and monitor used. Please refer to the description included in each product sheet.

Product prices are indicated on the website www.capslov.com and are inclusive of VAT or other applicable taxes. However, prices do not include delivery costs which, where applicable, will be added to the price of the products and will be communicated to you during the purchase process.

Prices may be subject to change. Please check the final sale price before submitting the relevant order.

All products sold by the Seller are covered by the legal guarantee of conformity for defects that appear within twenty-four (24) months from the date you take physical possession of the products.

In case of a lack of conformity, you have a period of twenty-six (26) months from the above date to file a complaint and you will have the right to request the free repair or replacement of the product. In the event that the aforementioned remedies are not possible or are excessively expensive, you will be entitled to a reduction in the price paid or to the termination of the sales contract. 4. Payments

 

Payment for the price of products and the related shipping and delivery costs must be made using one of the procedures available on the website www.capslov.com, as indicated in the order form.

In the case of payment by credit/debit card, financial information (e.g., credit/debit card number or expiration date) will be forwarded, via encrypted protocol, to our bank that provide related remote electronic payment services, without third parties having any access to it in any way.

Furthermore, this information will never be used by the Seller except to complete the procedures relating to your purchase and to issue refunds in the event of any returns of products, following the exercise of your right of withdrawal, or if it becomes necessary to prevent or report the commission of fraud on www.capslov.com to the police. The price for the purchase of products and shipping costs, as indicated in the order form, will be charged to your current account at the time of the actual shipment of the purchased products.

5. Shipping and Delivery of Products

It will be necessary to enter the address where you wish to receive the purchased items, among the preselected countries, as indicated in the appropriate section of the site.

The system will not allow you to complete the order procedure if the user requests the shipment of the product to be purchased to addresses to which the Seller cannot ship.

To learn about the specific methods of shipping and delivery of the products, go to the "Customer service" section. Please pay attention to what is reported in this section because the information contained therein forms an integral and substantial part of these General Conditions of Sale and, therefore, are deemed to be fully known and accepted by you at the time of transmission of the order4 form.

6. Customer Service

You can request any information through our assistance services by accessing the Customer Service area. As the Seller, after the conclusion of the purchase, we may contact you to provide further support and assistance.

7. returns 

Consult our Returns Policy, which forms an integral part of these General Conditions of Sale. In summary:

You will have the right to withdraw from the contract if you change your mind, for any reason and without any penalty, within thirty (30) days from the date you acquire physical possession of the products or, in the case of multiple packages delivered for the same order, of the last package delivered. To withdraw from the contract you can:

•    send an e-mail to capslovforcustomers@gmail.com specifying your decision to withdraw from the contract (and return the products), also providing the details relating to the date of receipt of the products, the order number, your first and last name, the e-mail address of the account associated with the order. In case of omission of any of the data required in the Return Form or other information to be provided in the context of the aforementioned e-mail (as detailed above), we may not be able to process your return request.

All products have an identification tag attached with a disposable seal. Do not remove the label or seal from the purchased products if you wish to return them. The right of withdrawal does not apply to orders relating to personalized products.


In the event that you decide to exercise your right of withdrawal for the purchased products, the Seller reserves the right not to accept returned products without the relevant tag or seal or that have been altered from their original state or damaged to an extent greater than that necessary to establish the nature, characteristics, and use of the products themselves.

9. Applicable Law

These General Conditions of Sale are governed by Italian law and in particular by Legislative Decree No. 206 of September 6, 2005, with specific reference to the legislation on distance contracts and by Legislative Decree No. 70 of April 9, 2003, on certain aspects relating to electronic commerce. 
In any case, no provision of these General Conditions of Sale may prevent the operation of the protections provided by the mandatory provisions of the law of your place of residence or domicile.

Any dispute relating to the interpretation and/or execution and/or termination of these General Conditions of Sale will be subject to the jurisdiction of the court of your place of residence or domicile.

For EU countries only: in the event of disputes arising from the General Conditions of Sale, please note that the European8 Commission provides a platform for alternative extra-judicial dispute resolution, accessible on the website

10. Changes and Updates

The General Conditions of Sale may be modified from time to time in consideration of possible regulatory changes or for other reasons. The new General Conditions of Sale will be effective from the date of publication on the website www.capslov.com and will become an integral part of the contracts at the time the consumer sends the first purchase order following the modification.
